The Purpose of this HOLD HARMLESS AGREEMENT is to promote Honesty and Responsibility for all involved in this private membership club. Due to the nature of your account being a digital service, acceptance of this Hold Harmless Agreement is considered to be equivalent to a wet ink signature where both parties agree to uphold and protect the welfare of each other.
This Hold Harmless Agreement (herein after called “Agreement”) is entered into by and between you and Public Record Posting, its trust, its partners, and affiliates. Please read this Hold Harmless Agreement carefully before you sign up to become a member and before recording each document. By signing up as a member and then recording a document, you accept and agree to be bound and abide by this Agreement herein. If you do not want to agree to the terms of this Agreement, you must not sign up to become a member.
Public Record Posting may revise and update this Hold Harmless Agreement from time to time in its sole discretion. All changes are effective immediately when posted. Your continued use of the Website following the posting of the revised Hold Harmless Agreement means that you accept and agree to the changes. You are expected to check this page each time you record a document, so you are aware of any changes, as they are binding on you.
In the same way your membership/account with Public Record Posting is voluntary and can be terminated at any time, Public Record Posting reserves the right to terminate your membership/account at any time, for any reason.
Public Record Posting only serves as the platform for document publishing specifically for the purpose of being able to easily share that document with the appropriate person or entity. Public Record Posting is not responsible for the validity of any recorded documents nor is it responsible for notifying any person or entity of your posting. It is merely a platform for publishing documents and providing a unique URL that can be shared or posted in/on places such as letters, emails, texts, newspapers, public library boards, social media, or other channels for posting documents.
The purpose of Public Record Posting is to provide a platform where men and women can publish their documents in a format that can be viewed by the public. As a result, by accepting our Hold Harmless Agreement you agree that your published documents will be available online through the search feature on the public domain PulbicRecordPosting.com and through the unique URL that is generated for each document and for your Profile.
You further understand that by publishing your documents, you may be contacted directly by individuals or entities that wish to dispute your statements. In the event this happens you agree that you will not hold Public Record Posting liable for any disputes, claims, or legal issues that may arise from the information contained in your documents.
Assumption of Responsibility: I am fully aware that publishing my documents online may result in the public finding information about me and I hereby accept the consequences and take responsibility, having engaged with Public Record Posting voluntarily.
Exemption from Liability: I hereby fully and forever discharge and release Public Record Posting from any and all liability, claims, demands, actions, and causes of action whatsoever arising out of any damages, both in law and equity, in any way resulting from legal, personal, physical, psychological or emotional injuries, distress, or death arising from or in any way related to the recording, publishing and sharing of my documents. This release from liability also includes loss, damage or injury resulting from the negligence of Public Record Posting from any other cause or causes.
Covenant Not to Sue: I agree not to institute, initiate, or assist the prosecution of any suit, claim or action at law or equity, or otherwise, against Public Record Posting for damages which I or my heirs, executors, administrators, or assigns hereafter may have arising from or in any way related to the recording, publishing and sharing of my documents. This release from liability also includes loss, damage, or injury resulting from the negligence of Public Record Posting from any other cause or causes.
Indemnity: I agree to indemnify and hold harmless Public Record Posting, its trust, its partners, and affiliates from any and all losses, claims, actions, or proceedings of any kind which may be initiated by me as a man or woman, and/or any other man, woman, person or organization on my behalf against Public Record Posting. This indemnification includes reimbursement by Public Record Posting for any and all legal costs and reasonable “legal” fees incurred as a result of such actions.
Waiver of Punitive Damages: I understand and agree that I am waiving and forever abandoning any claims for punitive or exemplary damages against Public Record Posting. I voluntarily choose to give up this Right.
Arbitration: I agree that any controversy claim against Public Record Posting not released herein, arising out of or relating to my membership and/or the recording, publishing and sharing of my documents, shall be settled by private arbitration in accordance with the rules of the American Arbitration Association, and not by lawsuit or resort to court process (except as the law provides for judicial review of arbitration proceedings). This shall apply to all claims including allegations that there have been wrongful acts or omissions by Public Record Posting either intentionally or otherwise. The arbitrator's decisions may be entered in any court having competent jurisdiction. By clicking the box, I am agreeing that any issue or claim arising out of my use of Public Record Posting shall be decided by neutral private arbitration. I am giving up my Right to a trial by a Jury or Judge.
Governing Law: I understand that this Agreement shall be construed and governed by the laws on Ohio State, without the United States, and that it cannot be modified unless in writing and signed by both parties.
Entire Agreement: I understand that this Agreement contains all the promises and agreements between parties with regard to the release of Public Record Posting and I acknowledge there are no oral or written promises or agreements outside of this Agreement regarding the release of Public Record Posting.
Binding: I hereby expressly recognize that this Agreement is binding, and I have released any and all claims against the indemnified parties resulting from my use of Public Record Posting, including any claims caused by the negligence of the indemnified parties.
I HAVE CAREFULLY READ THIS AGREEMENT AND UNDERSTAND ITS CONTENTS. BY CLICKING THE BOX, I AM AWARE AND CONSENT TO DIGITALLY SIGNING THIS AGREEMENT OF MY OWN FREE WILL. I RESERVE ALL MY RIGHTS NOT WAIVED, WITHOUT PREJUDICE, AND AGREE TO THIS HOLD HARMLESS AGREEMENT, WITHOUT THE UNITED STATES.
